Terms of Use & Safety Notice

Take Me Home is an app that is provided by Small Business Resource Center Online, Inc. dba Harmony Senior Housing. These Terms of Use & Safety Notice (the “Terms”) govern use of Take Me Home. By accepting these Terms and using the app, the user agrees to them to the extent permitted by applicable law. Internal acceptance revision: 2026-09-23-v6.

IMPORTANT SAFETY NOTICE

TAKE ME HOME IS A NAVIGATION AND PERSONAL-ASSISTANCE APPLICATION. IT IS NOT A 911 SERVICE, EMERGENCY DISPATCH SERVICE, MEDICAL ALERT OR MONITORING SERVICE, LAW-ENFORCEMENT SERVICE, AMBULANCE OR RESCUE SERVICE, CAREGIVER MONITORING SERVICE, FALL-DETECTION SERVICE, SECURITY SERVICE, OR GUARANTEE OF PERSONAL SAFETY. IN AN EMERGENCY, USE THE FASTEST AVAILABLE METHOD TO CONTACT 911 OR THE APPROPRIATE LOCAL EMERGENCY SERVICE.

1. Purpose and Scope

Take Me Home can reduce steps involved in navigation, nearby searches, finding a manually tagged parking location, contacting user-selected Trusted People, initiating the device's telephone/SMS functions, and handing requests to supported third-party applications or services. Features depend on the device, operating system, permissions, network, location services, third-party availability, and user configuration.

2. No Emergency-Service Reliance

The user must not rely on Take Me Home as the sole or guaranteed means of obtaining emergency assistance, communicating distress, transmitting location, reaching a Trusted Person, or reaching 911. The provider does not monitor the user, monitor messages or calls, dispatch responders, confirm receipt, or guarantee that anyone will respond.

3. Call 911 Feature

The Call 911 feature can initiate the device's telephone calling function after the app's confirmation/countdown flow. Take Me Home does not place, carry, route, answer, monitor, record, or dispatch the 911 call itself. Cellular service, device condition, operating-system behavior, location, telephone availability, and the public emergency system are outside the provider's control.

If Automatic Text for Call 911 is enabled, V1.0.9 may first open a location-message composer for selected Trusted People. The device may require the user to send or dismiss that message before the 911 countdown begins. THIS CAN DELAY INITIATION OF THE 911 CALL. If immediate emergency assistance is needed, the user should use the fastest available method to call 911 rather than waiting on any optional text or app workflow.

4. Automatic Text and SMS Limitations

Automatic Text means the app can automatically prepare/open a message based on the user's prior settings and current action. Depending on the device and operating system, the user may still be required to review the message and tap Send. The provider does not guarantee that a message is sent, delivered, read, understood, accurate, timely, or acted upon. Wireless carrier, recipient device, network, platform, and user actions are outside the provider's control.

5. Trusted People

The user is responsible for entering accurate Trusted Person information, obtaining permission to send messages, selecting appropriate recipients, and keeping the information current. A Trusted Person is not an employee, agent, emergency responder, or monitored-service representative of the provider merely because the person is saved in the app.

6. Location, Maps, Nearby Results, and Navigation

GPS, device location, map data, business listings, nearby search results, routes, addresses, arrival estimates, and third-party information may be inaccurate, incomplete, delayed, unavailable, or unsafe for current conditions. The user must obey actual road conditions, traffic laws, signs, warnings, closures, property restrictions, and instructions from authorities. The provider does not guarantee location accuracy or a safe/available route.

7. Parking

Find My Car depends on a successful user-initiated parking tag and device location. A saved parking pin may be inaccurate or unavailable. The provider does not guarantee recovery of a vehicle or lawful/safe parking.

8. Third-Party Services

Take Me Home may open or hand information to services not controlled by the provider, including device operating-system services, Apple/Google/device maps, Waze, ride providers, SMS/Messages, telephone services, wireless carriers, email providers, and PayPal Giving Fund. Their availability, pricing, accuracy, privacy, security, terms, and performance are governed by those providers. References or links do not constitute a guarantee or endorsement of their performance.

9. No Medical or Professional Advice

Take Me Home does not provide medical diagnosis, medical advice, legal advice, transportation advice, or professional emergency guidance. Nearby health-related destinations are informational/navigation features and are not recommendations that a facility is appropriate for a user's condition.

10. User Responsibilities and Assumption of Risk

The user is responsible for deciding whether and how to use the app; maintaining a working/charged device and service; granting only desired permissions; keeping Home, Saved Places, Trusted People, and preferences accurate; verifying destinations and routes; and using direct emergency methods when appropriate. To the extent permitted by law, the user assumes risks inherent in relying on mobile devices, GPS, networks, third-party services, SMS, telephone systems, and user-entered information.

11. Availability and Conditions Outside Our Control

Features may be interrupted or fail because of device failure, battery loss, lack of signal, carrier or internet outage, GPS limitations, operating-system changes, app-store/platform changes, third-party outages, cyber incidents, severe weather, disasters, government action, labor disruption, or other circumstances outside the provider's reasonable control. The provider does not guarantee continuous or uninterrupted availability.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAKE ME HOME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, NON-INFRINGEMENT, OR THAT THE APP WILL PREVENT INJURY, LOSS, DELAY, OR AN EMERGENCY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS ARISING FROM FAILURE OR DELAY OF GPS, LOCATION, SMS, TELEPHONE, NETWORKS, THIRD-PARTY SERVICES, ROUTING, DEVICE OPERATION, OR A TRUSTED PERSON'S RESPONSE, EVEN IF ADVISED THAT SUCH LOSS MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT THE USER PAID THE PROVIDER FOR THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US $100. TAKE ME HOME IS CURRENTLY PROVIDED FREE OF CHARGE. THESE LIMITATIONS DO NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

14. Indemnification

To the extent permitted by applicable law, the user agrees to indemnify and hold harmless the provider and its directors, officers, employees, volunteers, agents, and affiliates from third-party claims, losses, liabilities, damages, and reasonable costs arising from the user's unlawful misuse of the app, violation of these Terms, infringement of another person's rights, or knowingly inaccurate information supplied by the user. This provision does not require indemnification for the provider's own conduct where such indemnification is prohibited by law.

15. Privacy

Use of information is described in the Take Me Home Privacy Policy available through the app and at https://www.SmallBusinessResourceCenter.com/privacy-policy. Users should review that Policy before using the app.

16. Changes, Acceptance, and Termination

The app records acceptance of the applicable Terms/Safety revision locally. The current internal revision is 2026-09-23-v6. The provider may update these Terms as the app, law, or platform requirements change. Material changes may require renewed acceptance. The user may stop using the app at any time and may erase local Take Me Home profile/app data using available app controls or uninstall the app, subject to device/platform backup behavior.

17. Governing Law and Venue

To the extent permitted by applicable law, these Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute not subject to a mandatory law or forum that cannot be waived will be brought in a state or federal court with jurisdiction in Berks County, Pennsylvania, and the parties consent to that venue and jurisdiction. Nothing in this section deprives a consumer of non-waivable protections or forums provided by applicable law.

18. Severability; No Waiver; Entire Agreement

If a provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any required in-app notices, constitute the agreement concerning use of Take Me Home except where applicable law requires otherwise.
